Senate Bill 105 was signed into law in 2021 and allows pharmacists to administer or dispense contraceptives under a standing order from the Division of Public Health. This includes hormonal and non-hormonal contraceptives.
In 2026, Senate Bill 320 was signed which will give pharmacists independent prescriptive authority for conditions that do not require a new diagnosis, which includes contraception. This will go into effect on 7/29/2027 or when the Board of Pharmacy promulgates regulations to implement the act, whichever comes first. In the meantime, pharmacists can continue dispensing contraceptives under the standing order.
